Payment Terms

The following terms (these “Payment Terms”) govern payments you make or receive through www.myDreamDj.com (the ″Site″),

Please read these Payment Terms carefully before making or receiving payments through the Site. By making or receiving payments through the Site, you accept and agree, on behalf of yourself or on behalf of your employer or any other entity (if applicable), to be bound and abide by these terms and conditions.

For Users

A service fee of 5% of the total reservation amount will be charged to the Booker upon checkout. All taxes and charges that may apply will be available on the reservation confirmation page, and a email confirmation of the charge will be sent to the email associated with the account post the placing of the reservation.

The total charged amount will be placed into Escrow until the performance is completed, after which funds will be delivered to the performer or returned to the Booker; whichever applies under the provision of the Escrow term. Please view Escrow for more information on pending status funds.

Your MyDream Dj User Account Balance is always valued display in USD, even if original funds are sent in a different currency. Currency conversion fees will apply should the fund be sent in any other currency than USDs.

Though rare, Bookers may be granted a balance on their account which would be available to withdraw account credits, you must have an account with at least one of MyDream Dj′s Payment Service Providers for the withdrawal methods. All funds eligible for Withdrawal will be held on your behalf at an account with MyDream Dj′s Payment Service Provider. All payment services, including withdrawal services, will be provided by MyDream Dj′s Payment Service Provider. Performers and User accounts may withdraw their credits using one of MyDream Dj′s withdrawal options.

For Performers

Each gig completed will accredit performers with credits equal to 90% of the total reservation amount. MyDream Dj accredits Performed once an order is completed. If an order is canceled the funds and process will be determined by the Cancelation process (section 3 under Escrow).

Performers are responsible for paying any direct or indirect taxes, including any GST, VAT or income tax, which may apply to them depending on residency, location or otherwise, under provisions of their jurisdiction. Use and the acceptance of funds from MyDream Dj will be equal to the acceptance of compliance with your obligations under income tax provisions in their jurisdiction.

MyDream Dj will act as the Performer′s limited authorized payment collection agent solely for the purpose of accepting payments (via its Payment Services Provider, if applicable) from Booker, and remitting those payments to Performer. Performer agrees that payment from Booker to MyDream Dj shall be considered the same as a made directly to Booker, and all payment amounts will be credited as a balance on the Performer′s My Dream Dj user account. Available funds can be withdrawn and submitted to a bank account if desired and explicitly requested through the system.

Your MyDream Dj User Account Balance is always valued in USD, even if original funds are sent in a different currency. Currency conversion fees will apply should the fund be sent in any other currency than USDs.

Withdrawing Account Credits

To withdraw account credits, you must have an account with at least one of MyDream Dj′s Payment Service Providers for the withdrawal methods. All funds eligible for Withdrawal will be held on your behalf at an account with MyDream Dj′s Payment Service Provider. Performers and User accounts may withdraw their credits using one of MyDream Dj′s withdrawal options.

For security reasons, MyDream Dj may temporarily disable a User′s or Performer′s ability to withdraw credits to prevent fraudulent or illicit activity. This may come as a result of identified security risks, improper behavior reported by other users, or associating multiple MyDream Dj accounts to a single withdrawal provider.

Withdrawals can only be made in the amount available to you, and withdrawal fees may vary depending on the withdrawal method.

WITHDRAWALS ARE FINAL AND CANNOT BE UNDONE

To protect against fraud, unauthorized transactions (such as money laundering), claims, or other liabilities, payment information in connection with withdrawals is collected by either MyDream Dj or MyDream Dj′s Payment Service Providers.

Performers will be able to withdraw their credits from accounts within 30 days following full verification of ownership of the account in question, from the day of the last cleared payment received in their account and subject to MyDream Dj′s approval.

Purchases Mediums and Restrictions

In most locations, purchases on MyDream Dj can be made by using one of the following payment methods: Credit Card, PayPal, MyDream Dj Credits or existing MyDream Dj User Account Balance, and any existing MyDream Dj User Account Balance will be automatically applied to your next purchase.

USERS AND BOOKERS MAY NOT OFFER PERFORMERS TO PAY, OR MAKE PAYMENT USING ANY METHOD OTHER THAN THROUGH THE MYDREAM DJ SITE. PERFORMERS MAY NOT REQUEST TO BE PAID OUTSIDE OF THE MYDREAM DJ SITE BY USERS OR BOOKERS. IN THE CASE THAT USERS, BOOKERS, OR PERFORMERS ARE ASKED TO USE AN ALTERNATIVE PAYMENT METHOD, WE REQUEST THAT THIS BE REPORTED TO MYDREAM DJ CUSTOMER SUPPORT IMMEDIATELY AS THIS IS A DIRECT BREACH OF OUR TERMS.

You agree to receive invoices and/or payment receipts from MyDream Dj in electronic form as PDF documents, by email or through the Site.

By using any payment method and/or providing payment details for making purchases on MyDream Dj, you accept the following as valid and true:

You are legally authorized to provide such information
You are legally authorized or have permission to make payments using the payment method(s)
If you are an employee or agent of a company or person that owns the payment method, you are authorized by that company or person to use the payment method to make payments on MyDream Dj
Such actions do not violate any applicable law.

Taxes

MyDream Dj may be required by applicable laws to charge users with indirect taxes (such as Sales Tax, VAT or GST) or to withhold taxes. Any amount MyDream Dj will be required to collect will be in addition to the purchase amount and any other fees payable by the Booker, and any amount MyDream Dj will be required to withhold will be deducted from the Performer′s credits, as required by applicable laws.

Indirect taxes are in addition to the price shown on the site, and should they apply, any such taxes will always be displayed to the Booker or Performer on the reservation confirmation page.

Disputes and Cancellations

We encourage our Bookers and Performers to try and settle conflicts amongst themselves.

Should issues arise that can not be resolved, you can contact MyDream Dj′s Customer Support department for assistance. Please view Cancelation policy under section 3 in Escrow for more information. Filing a transaction dispute or reversing a payment through your payment provider or your bank is a violation of these Payment Terms. Doing so may result in your account being temporarily or permanently disabled. - Once you have filed a dispute with your payment provider, the funds in question will be ineligible for a refund due to our obligations towards the payment provider.

Chargebacks

MyDream Dj reviews cases of payment provider chargebacks and disputes on behalf of Performers. Although results vary per case due to each chargeback reason, disputes will be resolved in the Performer′s favor if possible and appropriate. If the chargeback case allows, MyDream Dj (or one of MyDream Dj′s Payment Service Providers) will return parts or full credits back to Performers, otherwise the chargeback amount will be borne by the Performer.

YOUR USE OF THE SITE, ITS CONTENT AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE IS AT YOUR OWN RISK. THE SITE, ITS CONTENT AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE ARE PROVIDED ON AN ″AS IS″ AND ″AS AVAILABLE″ BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER MY DREAM DJ NOR ANY PERSON ASSOCIATED WITH MY DREAM DJ OR IT AFFILIATES MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF THE WEBSITE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

IN NO EVENT WILL MY DREAM DJ, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.
