Getting Started with MyDreamDj.com

The following terms of service (these ″Terms of Service″), govern your access to and use of the Dream DJ website and mobile application, including any content, functionality and services offered on or through www.myDreamDJ.com, the Dream DJ mobile application (the ″Site″), and its subsidiaries and affiliates: Dream DJ, is owned by Chairman Solutions LLC. and it, and its subsidiaries, will collectively be referred to as ″Dream DJ″ ″we″ or ″us″ and “you” or “user” means you as an user, account owner of any category or level for the Site.

Please read the Terms of Service carefully before you start to use the Site. By using the Site, opening an account or by clicking to accept or agree to the Terms of Service when this option is made available to you, you accept and agree, on behalf of yourself or on behalf of your employer or any other entity (if applicable), to be bound and abide by these Terms of Service. Also please reference Dream DJ Payment Terms, and our Privacy Policy found in the section below. If you do not want to agree to these Terms of Service or the Privacy Policy, you must not access or use the Site. For more detailed policies surrounding the activity and usage on the Site, please access the designated articles herein.

This Site is offered and available to users who are 13 years of age or older. If you are under 13 you may not use this Site or the Dream DJ services. By using this Site, you represent and warrant that you are of legal age to form a binding contract and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site.

Please refer to our FAQ for any outstanding questions, or submit a ticket to our support team for further information on usage eligibility.

The original language of these Terms of Service, as well as all other texts throughout the Site, is English. Web browsers may alter the text for convenience, but in case of conflicts between the original English version and any translation, the English version shall prevail. Dream DJ will not be held responsible for any damages which might occur due to site usage, use of content or files transferred.

Key Terms and Definitions:

Key Terms and Definitions:
Bookers are users who purchase services on Dream DJ. Those who fall into this category may also be referred to as “User” or “Account Users” in this document. The term “Affiliate” referred to herein, is an entity that, directly or indirectly, controls or is under the control of Dream DJ, where control means having partial or total ownership of such entity.

User Account is a collaborative booker account, created via Dream DJ Business, as detailed on Dream DJ Business Terms of Service. User Account Team Member, or Team Member, is any user that is invited or uses a User Account, should this feature be enabled.

″Extras″ are additional services offered on top of the Performers′ hourly performance rate, and Dream DJ for an additional price defined by the Performer or My Dream DJ as would be applicable.

″Performer Page″ is where the performers can describe their Performance experience, skill, capability, etc., and where the booker can reserve the performer for a specified date, time, and event, and create an order. Performer Page may also be referred to as a ″Booker Account″ page

Gig/Gigs are services offered on Dream DJ. They may also be referred to as “Reservations”, “Performance” or “Performances”.

Orders are confirmation of the reservation of Booker′s time, skill, and efforts for a future event(s). Bookers and Users will be able to communicate with each other post initial order confirmation, and may share additional information, or make edits to the original agreement limited to extensions of the performance times, edits to genres of music, or cancelations of event(s) with due reason.
Orders are the formal agreements between a booker and User after a purchase was made from the User’s Account Page.

Overview of Main terms

Only registered users may buy and/or sell on Dream DJ. Registration is free, and in registering for an account, you agree to provide us with accurate, complete, and updated information and must not create an account for fraudulent or misleading purposes. You are solely responsible for any activity on your account, including but not limited to, maintaining the confidentiality and security of your password. We are not liable for any acts or omissions by you in connection with your account.

Gigs on Dream DJ may be offered at the per-hour price specified by the Performer, and are subject to alteration by Dream DJ to meet a minimum standard of $350 USD per performance. Users pay Dream DJ in advance to create and fulfill orders. See Payment Terms for more details.
Orders are purchased through the DJ Account confirmation button found on the Performers′ page.

The Privacy Policy is a part of these Terms of Service and incorporated herein by reference.
Users undertake to comply with Dream DJ’s Community Standards, which are a set of behavior rules and guidelines, applicable to the Dream DJ community, marketplace, and catalog in addition to these Terms of Service, as updated from time to time.

Users book performers to reserve their time and efforts for Gigs on Dream DJ to allow bookers to purchase their services. Users may also offer additional features from Performers should those additions be offered by the performer. Each reservation that is booked and successfully completed, accredits the performer′s account with revenue equal to 90% of the total purchase amount. Dream DJ accredits Performers post an order is completed, in accordance with our Escrow terms and process. Please view our ″Purchasing″ section below for a definition of a completed order, and our Payment Terms for more information about receiving payments, fees, and taxes.

Users may not promote their Gigs or any Dream DJ content via the Google Ads platform, without the express written consent of a Dream DJ executive representative.
The User′s rating is calculated based on the order reviews posted by bookers or User Account Team Members. High ratings allow Users to obtain advanced perks as described above at the discretion of Dream DJ. In certain cases, exceedingly low ratings may lead to the temporary or permanent suspension of the User’s account.

For security reasons, Dream DJ reserves the right to temporarily disable a User’s or Performer′s ability to withdraw revenue to prevent fraudulent or illicit activity. This may come as a result of security issues, improper behavior reported by other users, or associating multiple Dream DJ accounts to a single withdrawal provider. Users are responsible for obtaining appropriate liability insurance with coverage amounts that are sufficient to cover all risks associated with the event that the performer is being booked for.

Performance Reservations and Gigs

To maintain performance quality, and meet Booker’s expectations, scheduling multiple gigs at the same time is strictly prohibited for Performers. Users and Performers are allowed to schedule as many gigs as are possible to perform successfully.
Gigs and/or users may be removed by Dream DJ from the Site for violations of these Terms of Service and/or our Community Standards, which may include (but are not limited to) the following violations and/or materials:

Illegal or Fraudulent services
Spam, inappropriate, or deceptive offerings for reservations
Gigs that are misleading to bookers or others
Reselling of regulated content
Promoting Dream DJ and/or Dream DJ Gigs through activities that are prohibited by any laws, regulations, and/or third parties′ terms of service, as well as through any marketing activity that negatively affects our relationships with our users or partners.

Gigs that are removed for violations mentioned above, may result in the temporary or permanent suspension of the User’s or Performer′s account. Gigs that are removed for violations are not eligible to be restored or edited, and may be removed from our Search feature. Gigs may include pre-approved website URLs contained within the Gig description and requirements box. Gigs containing websites promoting content, which violates Dream DJ’s Terms of Service and/or our Community Standards, will be removed.

Gigs are required to have a complete and accurate description of the related service or offered. Performers′ Account page will be used as a self testimony, willingness, and ability to perform as expected. Recurring reports that don’t match the quality shown on the Performer′s Account page may lead to the Performer’s account losing status ratings or becoming permanently disabled.

Performers′ account page will include audio uploaded of performance quality to help with the evaluation of performers abilities.

Statements on the Gig Page that undermine or circumvent these Terms of Service is prohibited.

Dream DJ DOES NOT IMPLICITLY OR EXPLICITLY VERIFY THE PERFORMANCE ABILITY OF THE PERFORMER, AND IT IS THE USER WHO IS SOLELY RESPONSIBLE FOR EVALUATING AND SELECTING THE PERFORMER FOR THEIR EVENT.

Reservation Additions and Extras for Event offerings

Performers may offer additional services for an additional price explicitly through the Dream DJ site. If available, these additional offerings may cover different categories of services that are components to a higher quality performance experience.

Dream DJ strives to help Performers leverage their skills and provide quality performances to the Dream DJ community. We aim to empower top performers with the helpful tools they need to grow their performance business. Users who invest in self-promotion may achieve greater recognition, followings, and greater financial returns. Above-average offerings, delivery, and maintenance of high quality and ratings may be rewarded with special opportunities, benefits, and more earnings based on continued success and at the sole discretion of Dream DJ.

Dream DJ Performers can gain increased account status ratings based on their activity, performance and reputation. Users who cannot maintain their high-quality service, experience a severe drop in ratings, or stop delivering on time risk losing their User status, benefits, and temporary or permanent suspension of their account.

Users and Performers expected engagement standards:

When a booker reserves a performer for an event, both the user and performer will be notified by email as well as notifications on the site with the reservation details. Users will be able to communicate with performers to discuss additional event details and modifications to the needs.
Users may not offer direct payments to Performers using payment systems outside of the Dream DJ platform. Services requested on Dream DJ must be an allowed service on Dream DJ, and users should refrain from using Dream DJ for any purpose other than looking for performance and reservations services on the site. Accounts that violaters these standards will be subject to actions included, but not limited to warnings, impacts to account rating levels, account suspension, and termination of existing and future accounts.

Additionally, Users should recognize that there might be a need for Bookers or Performers to disclose certain confidential information to be used by Users for the purpose of the performance, and they will be under obligation to protect such confidential information from unauthorized use and disclosure. Therefore, Users and Performers agree to treat any information received from bookers as highly sensitive and classified. Protection of these terms will include, but are not limited to the following:

Maintain all such information in strict confidence
Not disclosing the information to any third parties unless given explicit written permission by the Booker or other Booker authorized party
Not using the information for any purposes other than the fulfillment of the performance reserved

Purchasing

Please refer to the Payment Terms for making Payments through the Dream DJ platform and to learn about fees and taxes. In addition, users should use the order confirmation and subsequent communications as an understanding of specific booker requirements and deliverables. All purchasing should be done through the Dream DJ site, as alternative methods are strictly prohibited. In case that Users or Performers ask to use an alternative payment method, please report it immediately as this would be a breach of our Terms of Service.

Orders and Reservations:
Once reservations are confirmed, your order will be created and given a unique Dream DJ order number. Upon ordering, the payment will be charged and held in Escrow by Dream DJ, and held until the booking party and performing party submit confirmation of the successful performance completion. The completion of a performance will only be identified as completed under the following circumstances

A performer and booker both marked the Gig as ″Completed″ without dispute
A performer marked an event as Complete, and no dispute is filed by the booker within 3 days

Escrow

If a Booker and a Performer enter into a reservation agreement on the Dream DJ site, then the Bookers funds for the event will be charged and put into Escrow. Funds will remain in Escrow until the performance is confirmed and completed and the funds will be moved to the performer′s Dream DJ account.

Section 1. Acceptance of a reservation
Through the Dream DJ site or App, bookers will search and select Performers that they would like to perform at their event, and Performers will have the opportunity to accept or decline the request. Post mutual acknowledgement and acceptance, funding Approval and any additional Funding Approval may be required herein, and provided electronically, including by email or support ticket, if applicable. Once a Client and Performer have agreed to a Service Contract, and the Booker and Performer have selected “Agree” on the reservation, or pages relating to the Service Reservation details, these Escrow Instructions constitute a binding agreement between the User, Performer, and Dream DJ.

Section 2. Funding
By sending a reservation offer to Performer or accepting a Gig offer from Bookers, Bookers and Users agree to deposit funds for the full amount of the Service Contract to be held in Escrow with Dream DJ. Funds deposited by User remain in the User Escrow Account until they are released to the Performer Account or released to Client Account. Dream DJ will release funds held in escrow in accordance with Section 3 of these Escrow Instructions, and all funds applied will be added to the user′s DreamDJ account. These funds can then be transferred to a Use′s bank account upon their request.

Section 3. RELEASE AND DELIVERY OF AMOUNTS IN ESCROW
Client and Performer authorize and instruct Dream DJ to release applicable Accounts to the Performer Escrow Account or Client Escrow Account, based on the instructions described in this section, or as otherwise required by applicable law or expressly permitted by the Terms of Service. The amount of each release will be delivered to the applicable Dream DJ User accounts in accordance with Performer’s or Client’s instructions, these Escrow Instructions, and the other Terms of Service.

3.1 - Release of funds to Performer
Performer and Booker authorize and instruct Dream DJ to release funds to the Performer Escrow Account on the occurrence of any of the following Release Conditions, such authorization and instruction to be irrevocable except as expressly provided in these Escrow Instructions:

A performer and booker both marked the Gig as ″Completed″ without dispute within the Dream DJ site or app
A performer marked an event as Complete, and no dispute is filed by the booker within 3 days
Neither Booker or Performer takes action for 14 calendar days from post the scheduled performance.

3.2 - Release of funds to Booker
Performer and Booker authorize and instruct Dream DJ to release funds to the Performer Escrow Account on the occurrence of any of the following Release Conditions, such authorization and instruction to be irrevocable except as expressly provided in these Escrow Instructions

Booker cancels the reservation
Performer cancels the reservation

Section 4. Refunds and Cancelations
If a reservation is to be canceled, the following rules will govern refunds processes, and continued access to the site. Cancelations are defined as a notification of a lack of ability or willingness to perform that act specified and previously agreed upon by both the Booker and Performer based on shared criteria in accordance with these Terms of Service.

Should a reservation be canceled by the booker within 2 calendar days (48 hours) of the event being held, the User will be refunded 50% of the total reservation amount. A percentage of the funds will be charged as service fees and the remaining will be credited to the Performer for their time and effort in preparing for the Gig. The funds remaining will be assigned to the use′s Dream DJ account as a credit which can be used for further bookings or returned to a bank account. Subsequent effects will be applied to the user accounts, including impacts to rating status, feature access, and suspension or termination of account based on frequency of action.

Should a reservation be canceled by the Performer within 7 calendar days (168 hours) of the event, A full refund will be provided to the users by way of credit on the user′s Dream DJ account which can be used for further bookings or returned to a bank account. Users will also be provided with alternative recommendations for performance based on the selected search criteria. Subsequent effects will be applied to the user accounts, including impacts to rating status, feature access, and suspension or termination of account based on frequency of action.

Any third party fees such as credit card or wire transfer fees will not be subject to refund or return.

4. INSTRUCTIONS IRREVOCABLE
Bookers and Performers are deemed to and hereby agree that the instruction to Dream DJ and its wholly owned subsidiaries to release funds is irrevocable, except as explicitly provided in these Escrow Instructions. Without limiting the foregoing, User’s instruction to Dream DJ Escrow and its wholly owned subsidiaries to release payment to Performer is irrevocable. Such instruction is Client’s authorization to transfer funds to the Performer Escrow Account from the User′s Account or authorization to charge User’s Payment Method. Such instruction is also User’s representation that the performance was completed in accordance with the requirements description, should this term apply.

Booker acknowledges and agrees entering into an approved funding status would give Dream DJ the explicit approval for the release of credits to the Performer′s Dream DJ Account or the Bookers′ Dream DJ account, whichever would be in accordance with these terms. Post this confirmation, Dream DJ will transfer the funds. Post transfer, Dream DJ releases any responsibility to recover such funds. THEREFORE, AND IN CONSIDERATION OF THE SERVICES DESCRIBED, USERS AGREE THAT ONCE Dream DJ ESCROW OR ITS SUBSIDIARIES OR AFFILIATES HAVE CHARGED CLIENT’S PAYMENT METHOD, THE CHARGE IS NON-REFUNDABLE.

To the extent permitted by applicable law, we may modify these Escrow Instructions without prior notice to you, and any revisions to these Escrow Instructions will take effect when posted on the Site unless otherwise stated, and the version of these Escrow Instructions in effect on the date posted. Please check the Site often for updates.

Reviews:

Reviews are an essential feedback system for Dream DJ, and are used in key metrics for the site. Once an event is completed, Bookers and Performers will be given the opportunity to share the experience of the event, and our two-way rating system helps ensure the safety, comfort, and authentic experience of Users and Performers.

Users and Bookers are encouraged to communicate prior and/or during the performance with regards to the event. This good faith and open communication will play an important role to ensure all parties are aligned and the end result (a truly spectacular event) is realized. Leaving feedback is a fundamental allowance of a booker and users to share how expectations and actualities aligned. Should reviews be publicized, feedback will not be removed unless there are clear violations of our Terms of Service and/or our Community Standards.

To prevent any misuse of our Feedback system, all feedback reviews must come from legitimate sales executed exclusively through the Dream DJ platform from users within our Community. Purchases arranged, determined to artificially enhance User ratings, or to abuse the Dream DJ platform with purchases from additional accounts, will result in a permanent suspension of all related accounts.

Feedback comments given by bookers may be publicly displayed on a Performer′s profile page. Withholding the delivery of services or information required to complete the service agreed upon with the intent to gain favorable reviews (or additional services) is strictly prohibited. Users are allowed to leave reviews on Orders up to 10 days after a performance is completed. No new reviews may be added to an Order after 10 days. Performers may not solicit the removal of feedback reviews from their bookers through mutual cancellations.

Disputes on Performance Completion and Quality:

We encourage our bookers and users to try and settle conflicts amongst themselves. If for any reason this fails, Dream DJ will open an investigation in which the order confirmation, User testimony, and Performer testimony will be evaluated. A verdict will be assigned by Dream DJ, and all appropriate actions will be taken. This will also be the case should Users encounter non-permitted usage on the Site. Users can and should contact Dream DJ′s Customer Support department for assistance in this case. User Conduct and Protection Policy:

Dream DJ enables people around the world to reserve incredible performances and experiences to enhance the fun of events at a great value. Services offered on Dream DJ reflect the diversity of an expanding performance space and mediums.

Dream DJ maintains a friendly, community-spirited, and professional environment, and all users are required to keep to that spirit while participating in any activity or extensions of Dream DJ. This section relates to the expected conduct that all users should adhere to while interacting with each other on Dream DJ.

To report a violation of our Terms of Service and/or our Community Standards, User Misconduct, or inquiries regarding your account, please contact our Customer Support team.

To protect our users′ privacy, user identities are kept anonymous until reservations are completed. Requesting or providing Email addresses, Skype/IM usernames, telephone numbers or any other personal contact details to communicate outside of Dream DJ in order to circumvent or abuse the Dream DJ messaging system or Dream DJ platform is not permitted. Any necessary exchange of personal information required to continue a service may be exchanged post confirmation of performance details, and can only be used to support the reservations′ success.

Dream DJ does not implicitly or explicitly provide any guarantee of the level of service offered to bookers, and any dispute can be submitted to the Dream DJ Support team. Dream DJ does not provide protection for users who interact outside of the Dream DJ platform.

All information and file exchanges must be performed exclusively on Dream DJ′s platform.
Rude, abusive, improper language, or violent messages will not be tolerated and may result in an account warning or the suspension/removal of your account. Dream DJ was built for the enjoyment of all its community members. Discrimination against a community member based on gender, race, age, religious affiliation, sexual preference or otherwise is not acceptable and may result in the suspension/removal of your account.

Users may not submit proposals or solicit for reservations to be held outside of the Dream DJ reservation system. Users with the intention to defame competing Users or Performer by ordering from competing services may have actions taken against their account. Such actions will be determined by our User Compliance team. Users are to refrain from spamming or soliciting Bookers or Users to pursue removing/modifying reviews or canceling reservations that do not align on Order Cancellation or Review policies.

Performers may report performance requests to Customer Support that may be in violation of Dream DJ’s Terms of Service based on the reported Gig’s replicated similarity to pre-existing services. Performers warrant that any content offered or used during the performance shall be original work conceived by the Users and shall not infringe any third party rights, including, without limitation, copyrights, trademarks or any other protected category. In the event that certain music, imaging, or video is incorporated within the performance, Performers represent and warrant that they hold a valid license to use such music and/or footage and to include them in the Gigs.
Dream DJ will respond to clear and complete notices of alleged copyright or trademark infringement that are brought to our attention.

Reporting Violations
If you come across any content that may violate our Terms of Service and/or our Community Standards, please report it to our support team. All cases are reviewed by our User Compliance team. To protect individual privacy, the results of the investigation will not be shared, but the outcomes may be notified to relevant parties. Please review our Privacy Policy and general terms of service for more information.

Violations
Users may receive a warning to their account for violations of our Terms of Service and/or our Community Standards or any user misconduct reported to our User Compliance team. A warning will be sent to the user′s email address and will be displayed for such user on the Site. Warnings do not limit account activity, but can lead to your account losing Account status ratings or becoming permanently disabled based on the severity of the violation.

Inappropriate Behavior & Language
Communication on Dream DJ should be friendly, constructive, and professional. Dream DJ condemns bullying, harassment, and hate speech towards others. To assist with the reservation process, we enable a medium for messaging between individuals, a system to rate performances, and to engage on larger platforms such as our Social Media pages. It is our expectation that this standard of professionalism and respect be carried out on all of these platforms

Spam and Fraud
Members’ security is a top priority. Any attempts to publish or send malicious content with the intent to compromise another member’s account or computer environment is strictly prohibited. Please respect our member′s privacy by not contacting them with offers, questions, suggestions or anything which is not directly related to the Gig details.

Privacy & Identity
You may not publish or post other people′s private and confidential information. Any exchange of personal information required for the completion of a service must be provided post reservation confirmation. Performers further confirm that whatever information they receive from the booker, which is not public domain, shall not be used for any purpose whatsoever other than for the delivery of a successful performance. Any users who engage and communicate off of Dream DJ will not be protected by our Terms of Service.

Authenticity in Profile Details
You may not create a false identity on Dream DJ, misrepresent your identity, create a Dream DJ profile for anyone other than yourself, or use or attempt to use another user’s account or information; Your profile information, including your description, skills, location, etc., while may be kept anonymous, must be accurate and complete and may not be misleading, illegal, offensive or otherwise harmful. Dream DJ reserves the right to require performers and users to go through a verification process in order to use the Site.

Intellectual Property Claims
Dream DJ will respond to clear and complete notices of alleged copyright infringement, and/or violation of third party’s terms of service. Any claims that are found to be true and in violation of law will be subject to warning, temporary suspension of the account, or termination of the account; you will also be subject to fines depending on the severity of the offense.

Unlawful Use
You may not use Dream DJ for any unlawful purposes or to conduct illegal activities. This includes but is not limited to fraud, money laundering, terrorism funding, tax evasion, and any other activities not permitted by law.

Abuse and Spam
To prevent fraud and abuse, users are limited to one active Dream DJ account. Any additional account determined to be created to circumvent guidelines, promote competitive advantages, or mislead the Dream DJ community will be disabled. Mass account creation may result in disabling of all related accounts. We do not tolerate users who engage in targeted abuse or harassment of any sort, including abuse focused on other users on Dream DJ. This includes creating new multiple accounts to harass members through our message or reservation system.

You may not buy or sell Dream DJ accounts.

ANY VIOLATIONS OF Dream DJ’S TERMS OF SERVICE AND/OR OUR COMMUNITY STANDARDS IS A CAUSE FOR PERMANENT SUSPENSION OF ALL ACCOUNTS.

Protections for the Site and it′s Services

The Site, including its general layout, design and content, is exclusively owned by Chairman Solutions LLC and protected by copyright and trademark law. Users have no right, and specifically agree not to do the following with respect to the Site or any component or extension of the Site (including its mobile applications):

copy, transfer, adapt, modify, distribute or reproduce it, in any manner
reverse assemble, decompile, reverse engineer or otherwise attempt to derive its source code, underlying ideas, algorithms, structure or organization
modify or create derivative works
remove any copyright notice, identification or any other proprietary notices,
use the Site in any manner that could damage, disable, overburden or impair the Site, or interfere with any other use of the website.

Users also agree not to permit or authorize anyone else to do any of the mentioned.

Should you choose to provide Dream DJ with any comments, suggestions or other feedback regarding the Dream DJ platform, products, or services, you agree to have granted Dream DJ an exclusive, royalty-free, irrevocable, worldwide ownership rights in the Feedback. Moreover, Dream DJ is under no obligation to implement any Feedback it may receive from users.

Updating Terms of Service.
Dream DJ may make changes to its Terms of Service. When these changes are made, Dream DJ will make a new copy of the terms of service available on the site. You understand and agree that if you use Dream DJ after the date on which the Terms of Service have changed, we will treat your use as acceptance of the updated Terms of Service.

Regulations on Content Uploads
All content uploaded to Dream DJ by our users (bookers and Users) is considered User Generated Content. Dream DJ does not check user uploaded/created content for appropriateness, violations of copyright or other rights or violations. The user uploading such content is solely responsible for it and the consequences of using, disclosing, storing, or transmitting it. By uploading to, or creating content on, the Dream DJ platform, you represent and warrant that you own or have obtained all rights, licenses, consents, and permissions to use the content legally. All users are encouraged to report violations with proof of ownership as appropriate. Reported violating content may be removed or disabled.

Furthermore, Dream DJ is not responsible for the content, quality or the level of service provided by the Users. We provide no warranty with respect to the performances, their delivery, or any communications between Performers and Users. We encourage users to take advantage of our rating system, and feedback avenues in choosing appropriate reservations.

ARBITRATION
Any dispute involving Booker, Users, Performers of Dream DJ will be settled through arbitration. Any Arbitration under this will be conducted by a neutral third-party Arbitration service, unless Dream DJ chooses another Arbitration service. If both Dispute Parties decline to take the matter to Arbitration or do not respond to Dream DJ’s Notice of Arbitration Demand within 5 calendar days, the Dispute Mediation ticket will be closed.
